Fox + Pearl Photography Terms & Conditions

Booking Fee
A $50 booking fee is required to secure all session bookings and is payable at the time of booking. This fee confirms your session date and time and helps cover the time spent planning and reserving your booking, as well as any potential loss of work in the event of a cancellation or no-show. Session times cannot be held without the booking fee being paid. The booking fee is non-refundable and will be deducted from the total cost of your session.

Weekend Fee
Weekend sessions are available by request only and incur a $175 weekend fee. Weekends are our dedicated family time and are in high demand. This fee reflects the limited availability and the time set aside to accommodate weekend bookings. The weekend fee is in addition to your chosen session or package price. (Newborn sessions are not available on weekends)

Session Availability
Studio and outdoor sessions are available Monday, Tuesday, Wednesday, and Friday between 10:00am and 2:30pm. Limited weekday evening sessions may be available by request after 5:00pm. Availability is subject to change and evening sessions are limited due to family commitments.

 

Cancellation and Change Policy

1. Your booking fee is non-refundable.

2. Booking fee secures your date and time. It also covers any loss of work and my time booking you in if you cancel/not show up.

3. If you need to change or reschedule your date please give as much notice as possible, preferably at least 5 days. Fox + Pearl Photography will gladly reschedule due to illness, provided notice is given.

4. If less than 2 weeks' notice is given to cancelling a session, or a no-show, you forfeit the session fee and this will not be moved to another date. If more than 2 weeks' notice is given, the booking fee can be used to reschedule once only and new booking must be made within 2 months of original date, after that, the booking fee is forfeited.

6. If you are more than 30mins late for your session, Fox + Pearl Photography will consider the session forfeited and cancelled.

7. Sessions will be rescheduled due to sickness/illness of either the client or photographer. Fox + Pearl Photography/Lindy Fox will not put clients health at risk, and will not put my own, or my family's health at risk. Session will be rescheduled when full health is restored.

 

Ordering Policy

1. Digital images will be available from 2-4 weeks after the photography session.

2. A personal online gallery will be offered from this time to view your password protected images, and here you can select the images you wish to purchase. You will then be able to download the selected images once full payment has been received.

3. Negatives, raw digital files, and any unedited photos are the property of the Fox + Pearl Photography. Photographs will be chosen by Photographer to edit and supply to Client. Client will not receive every photograph taken, only those chosen and edited by Photographer.

4. Images are archived within 6 months. If you require longer time to make you selection from the online gallery this will be charge at $30 per 2 extra months.

5. I will not chase payment from you. It is up to you to remember to pay for your session. Session images will not be edited or be available for viewing until full payment is received.

6. Payment plans are available.

7. Due to the nature of custom photography, all sales are final and strictly no refunds are given.

8. If there is a problem with the pictures/disc or if for some reason you are ABSOLUTELY UNHAPPY with your shoot or images you are welcome to re-shoot at 50% cost of the original package.

 

Vouchers

1. Vouchers must be paid in full or $ amount will be shown on voucher.

2. Vouchers are valid for 2 years only. Booking early is essential.

3. I cannot guarentee any dates, or availabilty if you do not book in advance. I recommend booking at least 6 months in advance to avoid missing out.

4. Once a session has been booked using a voucher, a voucher can be used to reschedule once only if more the 5 days notice is given and new date must be within 1 month of original date. If less than 5 days notice is given, or a no-show, or you cannot reschedule within a month of the original date, the voucher is forfeited.

5. Vouchers are treated as cash payment, and cannot be redeemed if lost. You must present your voucher as payment for your session.

 

Cooperation and Appearance

1. The parties agree to positive cooperation and communication for the best possible result within the definition of this session. Lindy Fox or Fox + Pearl Photography is not responsible if key individual’s failure to appear or cooperate during photography sessions or for missed photographs due to details not revealed to Lindy Fox or Fox + Pearl Photography.

2. Lindy Fox or Fox + Pearl Photography is also not responsible for the physical appearance of any individual being photographed and can only supply a suggestion sheet when requested.

3. It is not the responsibility of Lindy Fox or Fox + Pearl Photography to encourage your child to smile or behavior correctly.

4. The client shall assist and cooperate with the photographer in obtaining the desired photographs, including but not limited to specifying persons and/or scenes to be photographed, taking time to pose for photographs at the photographer’s direction.

5. Offensive behavior will not be tolerated towards any member of our staff/family. If a situation arises from you, family members or friends towards Fox + Pearl Photography, images from the shoot will be destroyed.

6. For cake smash session, you MUST tell Lindy Fox or Fox + Pearl Photography if there are any allergies when booking a cake smash session. Lindy Fox or Fox + Pearl Photography cannot be held responsible for any allergic reaction to the cake/icing from a cake smash session.

7. If you or your child is unwell, please let Lindy know at your earliest convieniance. Lindy works with newborns regularly and needs to be in good health to avoid spreading illnesses to newborns or anyone with a compromised immune system. Rescheduling is recomended in the case of illnesses.

 

Limit of Liability

1. In the unlikely event of medical, natural, or other emergency, it could be necessary to reschedule your photography session.

2. Lindy Fox and Fox + Pearl Photography take great care when handling babies and small children and as such we request a parent always remain within arm’s length while child is on/in prop in case child alters pose/position in away. If parents are not in arms reach and an accident occur Lindy Fox and Fox + Pearl Photography cannot be held liable for any injury to cause to the newborn, baby or child/ren.

3. Lindy Fox & Fox + Pearl Photography are not responsible for your child/rens behavior. When entering the location of studio and outdoor area, parents are fully responsible for their child/ren. Please do not let them play on equipment, or on photography props. Lindy Fox and Fox + Pearl Photography are not responsible for any incidents where a child may injure themselves. And parents are responsible for the cost of replacing any damaged props or equipment by themselves, or by their child.

4. Where a photography session takes place in a public area, park, beach etc, and an injury occurs to either an adult or a child, Fox + Pearl Photography and Lindy Fox cannot be held responsible. It is up to the signing client, and those within the group (adults and children) to be responsible for themselves, and their children.

5. Lindy Fox and Fox + Pearl Photography takes great care with respect to the transportation, processing, and storage of photographs. However, in the unlikely event those photographs have been lost, stolen, or destroyed for reasons within or beyond the photographer's control (including electronic malfunction), Lindy Fox and Fox + Pearl Photography’ s liability is limited to providing a replacement photography session. (Strictly no refunds are available)                                                                                                                                                  6. The use of cameras (still and video and smart phones) other than the photographer’s are prohibited during your session. Any breach of this agreement will constitute a reason for non-completion of the job with no liability to Fox + Pearl Photography and loss of deposit paid by signing party.

 

Copyright

1. The Federal Copyright Law protects copyright. By signing this agreement, you agree that all copyrights from your session are held only by Lindy Fox or Fox + Pearl Photography. It is unlawful to reproduce, scan, copy or print Fox + Pearl Photography’s work in any manner. This includes, but not limited to, re-burning discs, and otherwise sharing and distributing digital or printed images in any unauthorized manner. Please respect Fox + Pearl Photography’s livelihood and the care and attention paid to each of your images by adhering to copyright laws.

2. Editing of images in any way is strictly prohibited.

3. When purchasing digital images, you are permitted to print as many copies as you wish for your own personal use, as gifts, etc. Selling or using the digital or printed images for competitions’, commercial or business purposes are not permitted, unless express written permission is obtained from Lindy Fox or Fox + Pearl Photography. Any purchased images uploaded to social media must have credit given to photographer.
